Terms Of Use And Waiver

These Terms of Use (“Terms”) explain the agreement between you (the client) and SJJ Wellness LLC d/b/a Sona Spa Wellness (“Sona Spa Wellness,” “we,” “us,” or “our”).

By booking an appointment, visiting our studio, purchasing a membership, or using our website or online booking system, you agree to follow these Terms.

If you are a Member, your Membership Agreement (signed in-studio or online) works together with these Terms.

If you are visiting without a membership, you are considered a Guest, and these Terms apply to your visit and services.

If you do not agree with these Terms, you should not book or receive services from us.

Sona Spa Wellness provides professional massage and wellness services intended for relaxation, stress relief, and general well-being. Massage services are not a substitute for medical care, diagnosis, or treatment. Always consult a physician for medical conditions.

These Terms also include an Agreement to Arbitrate and a Class Action Waiver, which means any disputes must be resolved individually through arbitration, not in court and not as part of a class action.

1. Client Agreement

Sona Spa Wellness

1.1 Eligibility

To receive services at Sona Spa Wellness, you confirm that:

  • You are at least 18 years of age.
  • (If under 18, a parent or legal guardian must provide written consent.)
  • You are in suitable physical condition to receive massage or bodywork and do not have any medical condition, injury, or illness that could cause harm or be aggravated by massage.
  • You will only use our services for lawful and appropriate purposes.
  • You will not engage in any behavior that is unsafe, inappropriate, disruptive, or interferes with the comfort and privacy of others.
  • You will follow all studio policies and these Terms.

By booking or receiving services, you represent that the above statements are true.


1.2 Consent to Electronic Signatures

By booking an appointment online, completing digital forms, or clicking any button that indicates consent, you agree to these Terms just as if you had signed them in person.

Electronic signatures are legally valid under the U.S. E-Sign Act.

By selecting “Submit,” “Confirm,” “Agree,” or similar actions, you are entering into a legally binding agreement with Sona Spa Wellness.


1.3 Changes to These Terms

We may update or modify these Terms from time to time. Updated Terms may be posted on our website or provided through email or text.

Your continued use of our services after any changes become effective means that you agree to the updated Terms.

If you do not agree with the updated Terms, you must discontinue use of our services.

2. Client Consent to Service

Sona Spa Wellness

2.1 Consent to Receive Massage Services

Massage and bodywork may involve touch, pressure, stretching, and soft tissue manipulation. Techniques may vary based on your needs and the therapist’s professional judgment.

By booking and receiving services at Sona Spa Wellness, you voluntarily and knowingly consent to receive massage and wellness treatments. You understand that massage is intended to support relaxation, circulation, stress relief, and general wellness, and is not a substitute for medical care, diagnosis, or treatment.

You are responsible for informing your therapist of:

  • Any medical conditions
  • Injuries or sensitivities
  • Pregnancy
  • Pain or discomfort during the session

Your therapist will adjust techniques based on your needs and comfort.


2.2 Your Rights During the Session

You have the right to:

  • Ask questions at any time
  • Request pressure adjustments
  • Request changes in technique
  • Pause or stop the session
  • End the session entirely

Your comfort and safety are our priority.

Massage should never feel unsafe, pressured, or inappropriate.


2.3 Professional Boundaries

At Sona Spa Wellness:

  • You may disrobe to your comfort level; draping is used at all times.
  • Therapists are trained to maintain professional boundaries.
  • You are expected to communicate respectfully.
  • Any sexual, inappropriate, threatening, or disrespectful behavior is strictly prohibited and will result in immediate termination of the session and refusal of future service.

Therapists have the right to stop a service at any time if behavior is inappropriate, unlawful, or unsafe.

3. Services

Sona Spa Wellness

3.1 Services Offered

Sona Spa Wellness provides professional therapeutic massage and wellness services focused on relaxation, stress relief, improved circulation, and general well-being.

Our massage offerings may include, but are not limited to:

  • Relaxation massage
  • Deep tissue focus
  • Prenatal massage (2nd & 3rd trimester only)
  • Hot Stone massage
  • Cryo and Hot stone massage

We also offer optional enhancements (add-ons), which may include:

  • Hot stones
  • Scalp massage
  • Cupping
  • Gua sha
  • Body Scrub
  • Face sculpt

Services, pricing, service durations, enhancements, therapists, and availability may change at any time. We may update offerings to maintain quality and meet client needs.

3.2 Deposit Policy

To secure your appointment, a $50 deposit is required at the time of booking.

This deposit will be applied toward your service total on the day of your appointment.

If you need to reschedule, your deposit may be transferred to a new appointment within the same month, as long as we receive at least 24 hours’ notice.

  • Rescheduling with less than 24 hours’ notice will result in the deposit being forfeited.
  • Deposits are non-refundable.

3.3 Cancellation & Rescheduling Policy

We kindly request that all cancellations or rescheduling be made at least 24 hours prior to your scheduled appointment time.

  • Rescheduling with 24+ hours’ notice:
  • Your existing $50 deposit may be transferred to a new appointment within the same calendar month, subject to availability.
  • Cancellations or rescheduling with less than 24 hours’ notice, or same-day changes:
    • The $50 deposit is non-refundable, and
    • A new deposit will be required to book any future appointment.

3.4 No-Show / No-Call Policy

If you fail to arrive for your appointment without prior notice or communication, the appointment will be considered a No-Show.

  • The $50 deposit is non-refundable, and
  • A new deposit will be required to schedule a future appointment.

3.5 Late Arrival Policy

We kindly ask that you arrive 10–15 minutes early to allow time to check in and relax before your session begins.

If you arrive late to your appointment:

  • Your session may need to be shortened to avoid delaying the next guest.
  • If you are more than 15 minutes late, your appointment may need to be rescheduled, and your deposit will not be refunded.

3.6 Guests (Non-Members)

If you purchase a service without a membership, you are considered a Guest.

  • Payment is required in full at the time of service.
  • We accept major credit or debit cards. (Cash acceptance may vary — please ask.)
  • Services cannot be transferred to another person without approval.
  • Guests may be asked to complete an intake form and present valid ID if needed.
  • All Guests must follow studio policies and treatment guidelines.

3.7 Minors

  • Massage services are available to minors ages 13–17 with a parent or legal guardian present in the studio.
  • A parent/guardian must:
    • Sign the consent form,
    • Take responsibility for payment, and
    • Approve the massage session.
  • We may require the parent/guardian to remain in the room or nearby, depending on comfort and therapist preference.
  • For safety reasons, prenatal massage is only available starting in the 2nd trimester.

3.8 Members

If you purchase a monthly membership, you are considered a Member of Sona Spa Wellness. As a Member, you will enter into a Membership Agreement that works together with these Terms.

Memberships are billed on a recurring monthly basis to the payment method you keep on file. Your membership will automatically renew each month until cancelled by you or by Sona Spa Wellness.

All membership benefits apply only while the membership is active and in good standing.

Membership Benefits

Your membership includes your choice of:

  • One 60-minute massage per month, or
  • One 90-minute massage per month
  • (depending on the membership selected)

Members may purchase unlimited additional massages for personal use at discounted member rates.

Roll-Over Policy

Unused monthly massage credits will roll over to the following month.

Late Cancellation / No-Show

If you cancel or do not show for an appointment with less than 24 hours’ notice, the massage credit for that month will be counted as used.

Guest Privileges

Members may bring a guest to receive services at the member rate.

Guest privileges are limited to:

  • Up to 3 visits per guest per 12-month period
  • Applies only to new guests who have not visited Sona Spa Wellness in the past 12 months

Membership Cancellation

When you cancel your membership:

  • Your membership benefits remain active until the end of your current billing cycle.
  • Any unused membership credits expire 60 days after cancellation.
  • Memberships and credits are non-transferable and non-refundable.

Account Information

Members are responsible for notifying Sona Spa Wellness of any changes to:

  • Credit/debit card on file
  • Billing information
  • Contact information
  • Address

4. General Sona Spa Wellness Policies

4.1 Respectful Environment

All guests are expected to treat our spa environment, therapists, and fellow clients with respect and courtesy.

SONA SPA WELLNESS reserves the right to refuse, modify, or discontinue services at any time if behavior is deemed unsafe, inappropriate, or disruptive.

4.2 Right to Modify Services & Pricing

SONA SPA WELLNESS reserves the right to update or modify spa policies, services, operating hours, and pricing at any time to maintain service quality, operational standards, and business needs.

4.3 Studio-Initiated Cancellations

In the event of unforeseen circumstances—including illness, emergencies, or scheduling issues—SONA SPA WELLNESS may reschedule or cancel an appointment.

If the studio initiates the cancellation:

  • Any deposit paid will be fully refunded or credited toward a future appointment, at the client’s choice.

4.4 Personal Belongings

SONA SPA WELLNESS is not responsible for lost, stolen, or damaged personal items. Guests are encouraged to keep all valuables with them at all times.

5 Sona Spa Wellness Rules & Conduct

To ensure a safe, relaxing, and respectful environment for all, Members and Guests are expected to:

  • Treat all staff and other guests with courtesy and respect
  • Communicate honestly regarding comfort levels and health information
  • Follow all spa policies and therapist guidance during sessions
  • Refrain from disruptive, unsafe, or inappropriate behavior
  • Comply with all applicable laws, including those regarding alcohol or substance use

Sona Spa Wellness maintains a zero-tolerance policy for:

  • Harassment of any kind
  • Sexual or suggestive comments or behavior
  • Aggressive, threatening, or disrespectful conduct
  • Intoxication or drug impairment during services or on the premises

If, in our judgement, a Member or Guest violates these rules or behaves in a manner that compromises the comfort or safety of others, Sona Spa Wellness reserves the right to:

  • Refuse or discontinue service
  • Ask the guest to leave the premises
  • Cancel upcoming appointments
  • Suspend or terminate membership privileges

These decisions may be made at our discretion to ensure the well-being of both clients and staff, and to preserve the calming atmosphere of our spa.

6 Payment Processing

Payments for services and memberships at Sona Spa Wellness are processed through a secure, encrypted payment system. Your payment information is stored securely by our payment processor and is not stored on Sona Spa Wellness servers.

Sona Spa Wellness may use a third-party payment processor to:

Encrypt and store card information

Process membership billing

Process service charges and deposits

7 DISCLAIMERS; LIMITATION OF LIABILITY

Sona Spa Wellness

The website, online booking system, service descriptions, digital content, and all materials provided by Sona Spa Wellness (collectively, the “Services”) are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, completeness, availability, suitability, or effectiveness of the Services.

To the fullest extent permitted by law, Sona Spa Wellness disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of our website and services is at your own risk.

We do not warrant that:

  • The website or booking system will operate without interruptions or errors
  • Any defects or technical issues will be corrected
  • The website or the server hosting it will be free of viruses or harmful components
  • The information provided online is fully accurate, complete, or up to date

The spa may use third-party platforms (such as Vagaro, Acuity, Square, or similar systems) for online scheduling, payments, or messaging. We do not control and are not responsible for:

  • The security practices of third-party platforms
  • Website outages or booking errors caused by third-party services
  • The actions, content, or policies of third-party providers

You agree to use your own judgment and take appropriate caution when relying on any information or services.


Wellness Service Disclaimer

Massage and spa services are intended for relaxation and general wellness.

Our therapists do not diagnose, treat, or prescribe. Massage is not a substitute for medical care.

You are responsible for communicating:

  • Health conditions
  • Allergies or sensitivities
  • Pregnancy
  • Pain or discomfort during treatment

Failure to disclose these conditions may increase risk, and Sona Spa Wellness is not liable for adverse reactions resulting from withheld information.


Limitation of Liability

To the fullest extent permitted by law, Sona Spa Wellness, its owners, employees, contractors, and therapists shall not be liable for any:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Injury, discomfort, or outcomes related to treatment response
  • Personal items lost, damaged, or stolen at the studio
  • Inability to access or use the website or booking system

If you are dissatisfied with any part of the site, services, or studio experience, your sole remedy is to discontinue use.


Maximum Liability

Where liability cannot be excluded, our total liability shall not exceed the greater of:

  1. The total amount paid for the service in the 30 days prior to the event giving rise to the claim,
  2. or
  3. Five dollars ($5.00).

Agreement

By:

  • Booking an appointment,
  • Visiting the studio,
  • Using our website,
  • Or purchasing any services or products,

you confirm that you have read, understood, and agree to this Disclaimer & Limitation of Liability.

Indemnification

By using the website, booking system, or receiving services from Sona Spa Wellness, you agree to indemnify, defend, and hold harmless Sona Spa Wellness, including its owners, therapists, employees, independent contractors, and agents, from and against any and all claims, demands, losses, liabilities, damages, or expenses (including reasonable attorneys’ fees) that arise from:

  • Your use or misuse of our website, studio, or services,
  • Your violation of these Terms of Use,
  • Your violation of any applicable law or regulation,
  • Your failure to provide accurate and complete health information prior to receiving services,
  • Any injury, reaction, or outcome resulting from undisclosed health conditions, allergies, or sensitivities,
  • Any actions or conduct before, during, or after your visit that leads to a claim against Sona Spa Wellness.

Sona Spa Wellness reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to this indemnification. You agree to fully cooperate, at your expense, in the defense of such claims.

We will make reasonable efforts to notify you of any claim, action, or proceeding that is subject to this indemnification once we become aware of it.

GENERAL RELEASE & LIABILITY WAIVER

Sona Spa Wellness

All references to “I” or “me” below refer to the client or guest receiving services.

By signing or booking an appointment with Sona Spa Wellness, I acknowledge and agree to the following:

I voluntarily consent to receive massage, bodywork, wellness treatments, or related services (collectively, the “Services”) from Sona Spa Wellness. I understand that my health and safety in relation to these Services are my own responsibility. I am aware that massage and bodywork may involve certain physical risks, including but not limited to muscle soreness, soft tissue strain, temporary discomfort, allergic reactions to oils or products, or aggravation of existing conditions.

I acknowledge that my decision to receive Services is voluntary and that I assume all risks associated with such Services.


Release of Liability

In exchange for receiving the Services, I, for myself and on behalf of my heirs, executors, administrators, and personal representatives, hereby waive, release, and discharge Sona Spa Wellness, its owners, independent contractors, therapists, employees, and agents (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, injuries, liabilities, costs, or expenses (including attorneys’ fees) of any kind arising from or related to:

  • My receipt of Services,
  • My presence on the premises,
  • Any pre-existing or undisclosed medical condition,
  • Any personal health decisions I make regarding participation in the Services.

This release applies even if the claim arises due to negligence of the Released Parties, except in cases of intentional misconduct or gross negligence.


Client Health Responsibility

I understand that massage and bodywork are intended for relaxation, stress reduction, and muscle relief, and are not a substitute for medical examination, diagnosis, or treatment.

I affirm and agree that:

  • I have disclosed all known medical conditions, allergies, pregnancy status, and medications.
  • I will update Sona Spa Wellness and my therapist regarding any changes to my health.
  • I am solely responsible for consulting a physician regarding any medical conditions.
  • The Released Parties are not liable if I fail to disclose relevant health information.

Contagious Illness & Exposure Acknowledgment

I acknowledge that receiving Services involves personal proximity and physical contact,

10. Agreement to Arbitrate; Class Action Waiver

Sona Spa Wellness

10.1 Agreement to Arbitrate

For purposes of this Section 10, “Sona Spa Wellness,” “Sona,” “we,” and “us” mean Sona Spa Wellness and its owners, employees, independent contractors, agents, representatives, successors, and assigns.

Binding Arbitration. You and Sona agree that any dispute, claim, or controversy (collectively, “Claim”) arising out of or relating to these Terms, your use of our website or booking platforms, or any products or services provided by Sona, will be resolved exclusively by binding arbitration on an individual basis and not in court, except as expressly provided below.

This Agreement to Arbitrate applies to all Claims, whether based in contract, statute, regulation, ordinance, tort (including negligence and intentional torts), common law, or equity, and whether arising before or after the effective date of these Terms.

Exceptions.

You or we may:

  1. bring a Claim in small claims court if it qualifies; and/or
  2. seek temporary injunctive or equitable relief in a court of competent jurisdiction to protect confidential information or intellectual property, subject to Section 10.2 (Class Action Waiver).

Venue for Non-Arbitrable Claims. If a court determines a particular Claim is not subject to arbitration, such Claim may be brought only in the state or federal courts located in Los Angeles County, California, and you and Sona consent to personal jurisdiction and venue in those courts for that limited purpose.

Governing Law—FAA. This Agreement to Arbitrate is governed by the Federal Arbitration Act (FAA), including its procedural provisions. The FAA governs the interpretation and enforcement of this Agreement to Arbitrate, including the Class Action Waiver below.

Who Decides Arbitrability. A judge in a court of competent jurisdiction (not the arbitrator) will decide issues relating to the interpretation, validity, enforceability, or unconscionability of this Agreement to Arbitrate and whether any Claim is subject to arbitration.

Starting Arbitration; Rules; Fees. To begin arbitration, send a written request describing your Claim to:

Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures (or, if applicable, its Comprehensive Rules) and any applicable Consumer Arbitration Minimum Standards. JAMS rules are available at www.jamsadr.com or (800) 352-5267. Filing, administration, and arbitrator fees will be governed by JAMS rules. You may choose to have the arbitration conducted by telephone, by written submissions, or in person in Los Angeles County, California, unless we mutually agree to another location.

Award; Judgment. The arbitrator may award individual relief that would be available in court (consistent with these Terms). Judgment on the award may be entered in any court with jurisdiction.

Purpose; Survival; Severability within Section 10.1. This Agreement to Arbitrate is intended to provide a quick and cost-effective method to resolve disputes. It survives termination of these Terms and your relationship with Sona. Except for Section 10.2 (Class Action Waiver), if any provision in this Section 10.1 is found unenforceable, the remaining provisions will still apply to the maximum extent permitted by law.


10.2 Class Action Waiver; Jury Trial Waiver

YOU AND SONA SPA WELLNESS AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY and NOT as a plaintiff or class member in any purported class, consolidated, representative, private attorney general, or collective action or proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

YOU AND SONA WAIVE ANY RIGHT TO A JURY TRIAL and to participate in a class action, class arbitration, representative action, or similar proceeding.

If this Class Action Waiver is found unenforceable, then this entire Section 10 (Agreement to Arbitrate; Class Action Waiver) is null and void, and neither party will be required to arbitrate any Claim.


10.3 30-Day Opt-Out Right

You may opt out of this Agreement to Arbitrate within thirty (30) days after the date you first accept these Terms (for example, by booking or using our site after the Terms are posted/updated).

To opt out, you must send a written notice stating “I opt out of the Arbitration Agreement in Sona Spa Wellness Terms” along with your full name, mailing address, phone number, and (if applicable) email used for booking to:

Your opt-out will be effective only if we receive it within 30 days. Opting out will not affect the rest of these Terms, which will remain in full force.


10.4 Miscellaneous

  • No Waiver by Provisional Relief. Either party may seek provisional remedies (e.g., temporary restraining orders) without waiving the right to arbitrate.
  • Survival. This Section 10 survives termination of these Terms and completion of any services.
  • Severability (Limited). Except as stated in Section 10.2, if any part of this Section 10 is found unenforceable, the remainder will be enforced to the maximum extent permitted.

Consent to Contact

Sona Spa Wellness

11.1 Informational Communications

By providing your contact information to Sona Spa Wellness, you authorize Sona Spa Wellness and its employees, service providers, and communication partners (collectively, the “Messaging Parties”) to contact you for informational and service-related purposes. This may include communication regarding:

  • Appointment reminders and confirmations
  • Scheduling updates or changes
  • Payment or billing notices (if applicable)
  • Studio closures, policy updates, or important service notices

You agree that such communications may be sent using:

  • Text messages (SMS/MMS)
  • Phone calls (including calls made using automated systems)
  • Voicemail (including prerecorded messages)
  • Email and digital messaging platforms

You authorize the Messaging Parties to contact you at any telephone number or email address you provide, whether mobile, landline, or VoIP. You understand that standard messaging, voice, and data rates may apply, and you agree that the Messaging Parties are not responsible for any charges associated with these communications.

You understand and acknowledge that anyone who has access to your phone or email may be able to hear or view messages sent to you, and you agree that Sona Spa Wellness is not responsible for unauthorized access to your messages.

You understand that, at any time, you may withdraw your consent to receive text messages and calls to your cell phone or to receive artificial or prerecorded voice message system calls by calling the phone number for the Sona Spa Wellness entity listed in your Membership Agreement or Client Intake Form or writing to us at the spa address listed in your Membership Agreement or Client Intake Form, or such other address designated by us. To stop text messages, you can also simply reply “STOP” to any text message the Messaging Parties send you.

Your consent to receive informational communications will remain valid unless and until you withdraw it, even if your services or relationship with Sona Spa Wellness ends.


11.2 Promotional Communications (Optional Opt-In)

If you would like to receive information from us about promotions or other services that may be of interest to you, you may opt-in online or using an in-spa form with the applicable email and/or SMS opt-in checkbox(s). By doing so, you are giving the Sona Spa Wellness entity listed in your Online Account, Membership Agreement or Client Intake Form (and its authorized vendors) consent to contact you by email to the email address as set forth in your Online Account, Membership Agreement or Client Intake Form, or by text message or telephone call at the number provided in your Online Account, Membership Agreement or Client Intake Form for promotional purposes. You may update your communication preferences or revoke your consent to receiving promotional messages at any time. Your consent is not a condition of purchase.Unsubscribing from promotional messages does not affect your ability to receive important appointment and service-related messages.

CALIFORNIA USERS AND RESIDENTS

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

Miscellaneous

Sona Spa Wellness

13.1 Amendments

Sona Spa Wellness may update or modify these Terms, service policies, pricing, or our Privacy Policy at any time. Any changes will be effective when posted on our website or communicated by email or text where appropriate.

You are responsible for reviewing these Terms periodically for updates. If you continue to use our services after changes go into effect, you are agreeing to the updated Terms.

If you do not agree with any changes, you must discontinue use of our services.

13.2 Entire Agreement

These Terms constitute the entire agreement between you and Sona Spa Wellness regarding the services and supersede any prior agreements, statements, or representations.

13.3 No Waiver

If Sona Spa Wellness does not enforce a provision of these Terms immediately, that does not mean we waive our right to enforce it later. A waiver is only valid if it is made in writing and signed by Sona Spa Wellness.

13.4 Independent Contractors

Sona Spa Wellness and its clients are independent parties. Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship. You may not act on behalf of or bind Sona Spa Wellness in any way.

13.5 Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. The invalid portion will be adjusted only as necessary to reflect the original intent as closely as possible.

13.6 No Third-Party Beneficiaries

These Terms are for the benefit of you and Sona Spa Wellness only. No other person or entity has rights under this Agreement.

13.7 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Sona Spa Wellness may assign these Terms (such as in the event of sale or reorganization of the business).

13.8 Survival

Any provisions that by their nature should continue to apply after termination (such as liability limits, waivers, dispute resolution, and payment obligations) will continue to apply and survive the end of this Agreement.
